End User License Agreement

The license covers object-code versions of FD Incident Reports, PD Incident Reports, Command Center, updates, and documentation made available by Defensive Thinking. You may not sell, sublicense, lease, assign, redistribute, or make the applications available to unauthorized third parties. Except where prohibited by law, you may not copy, modify, decompile, reverse engineer, disassemble, circumvent security controls, or create derivative works from the applications.

You represent that you have authority to use the applications on behalf of yourself or your agency, that you will not use them for unlawful, infringing, abusive, or misleading purposes, and that you will maintain your own operational workflows, records, reviews, and retention decisions. The applications support reporting and operational coordination, but they are not a substitute for emergency dispatch, legal review, medical judgment, officer judgment, or incident command decision making. You agree to defend, indemnify, and hold harmless Defensive Thinking from third-party claims, losses, or expenses arising out of your misuse of the applications, violation of law, or violation of this agreement.

We do not intentionally collect report narratives, attachments, case files, witness statements, patient details, or similar user report content through our analytics or crash-reporting tools. Limited technical data such as app version, device type, operating system, session activity, error logs, and crash diagnostics may be collected to improve product stability and performance. Our Privacy Policy in privacy.html is incorporated into this agreement by reference.

The applications may rely on operating-system services, analytics providers, crash-reporting tools, or other third-party functionality. Defensive Thinking is not responsible for third-party services, store platforms, networks, or hardware outside our control. Apple and Google are not responsible for providing maintenance or support for the applications unless required by applicable law.

To the maximum extent permitted by law, Defensive Thinking disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted availability, and error-free performance. Defensive Thinking will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, loss of profits, loss of data, operational interruption, procurement of substitute services, or agency losses arising from use of or inability to use the applications. If liability cannot be excluded, Defensive Thinking's aggregate liability will be limited to the amount paid for the applicable application license in the twelve months preceding the claim.

Upon termination, you must stop using the applications and delete copies under your control. This agreement is governed by the laws of the State of Tennessee, excluding conflict-of-law rules, unless applicable law requires otherwise. For iOS distribution, this agreement is between you and Defensive Thinking, not Apple. Apple has no obligation to furnish maintenance or support services for the applications, is not responsible for product claims except as required by law, and is a third-party beneficiary of this agreement with the right to enforce it. You also represent that you are not located in, under the control of, or a national or resident of any U.S. embargoed country or on any U.S. government prohibited or restricted party list.
